Depending on your interaction with Hines, we may collect:

Scheduling information, including case captions, case numbers, proceeding dates, locations, witness names, attorney information, interpreter requirements, videography requirements, service instructions, and related information.

Litigation and proceeding materials, including deposition notices, pleadings, exhibits, transcripts, recordings, photographs, videos, medical records, correspondence, and other documents provided in connection with Services.

Account information, including login credentials or account identifiers associated with secure transcript or file access.

Transaction and billing information, including billing contacts, invoices, payment status, transaction details, and related financial information. Payment card information may be processed by third-party payment processors rather than stored directly by Hines.

Communications, including emails, telephone inquiries, scheduling requests, customer-service communications, feedback, and other correspondence.

Court reporter and contractor information, including licensing and certification information, tax information, payment information, professional qualifications, availability, and assignment information.

Information Collected Automatically

When you use our Site, we or our service providers may automatically collect information such as:

approximate geographic location derived from IP address;

interpreters;

other persons involved in scheduling or conducting proceedings.

4. How We Use Personal Information

Hines may use personal information to:

schedule and perform court reporting and litigation-support Services;
communicate regarding assignments and proceedings;
produce, process, certify, store, and deliver transcripts and related materials;
coordinate court reporters, interpreters, videographers, exhibit technicians, conference facilities, and other service providers;
facilitate remote, hybrid, and in-person proceedings;
process orders and payments;
administer accounts;
respond to inquiries and requests;
maintain customer relationships;
provide technical and customer support;
secure our Site, systems, accounts, and information;
detect or prevent fraud and unauthorized activity;
maintain business and accounting records;
improve our operations and Services;
comply with legal, regulatory, professional, and contractual obligations;
establish, exercise, or defend legal rights; and
perform other purposes disclosed when information is collected.

5. Litigation Materials and Sensitive Information

Because of the nature of court reporting and litigation support, information processed by Hines may contain sensitive personal information, including medical information, financial information, identification numbers, information regarding legal disputes, and information subject to confidentiality obligations or protective orders.

Hines processes such information as necessary to provide requested Services and meet applicable legal, professional, and contractual obligations.

Nothing in this Privacy Policy changes any legal restriction governing access to, disclosure of, or retention of the official record of a legal proceeding.

6. Protected Health Information

Certain assignments may involve information regulated under the Health Insurance Portability and Accountability Act (“HIPAA”) or other health-privacy laws.

Where Hines is legally required to enter into a Business Associate Agreement or otherwise comply with HIPAA requirements applicable to a particular relationship, Hines will handle protected health information in accordance with those obligations.

7. How We Disclose Information

Hines may disclose personal information to:

Court reporters and litigation professionals. We may provide information to court reporters, interpreters, videographers, scopists, proofreaders, transcriptionists, exhibit technicians, and other professionals necessary to fulfill assignments.

Service providers. We may use providers for website hosting, cloud storage, file transfer, communications, videoconferencing, information technology, cybersecurity, payment processing, accounting, shipping, and other business functions.

Customers and proceeding participants. Information and litigation materials may be provided to authorized attorneys, law firms, parties, witnesses, or other participants consistent with the assignment and applicable law.

Professional advisers. Information may be disclosed to attorneys, accountants, insurers, auditors, and other advisers.

Legal and governmental authorities. Hines may disclose information where required by subpoena, court order, law, regulation, or legal process, or when reasonably necessary to protect rights, safety, security, or property.

Business transactions. Information may be transferred in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar corporate transaction, subject to applicable law.

8. Sale and Sharing of Personal Information

Hines does not sell personal information for monetary consideration.

ATTORNEY/CLIENT REVIEW NOTE: Hines should confirm all advertising, analytics, pixels, and cookies operating on the redesigned website before finalizing the CCPA definition of “sale” or “sharing.”

Hines will honor legally required opt-out rights applicable to its actual data practices.

9. Data Retention

Hines retains information for periods reasonably necessary to:

provide Services;
maintain business and transaction records;
satisfy contractual requirements;
comply with applicable statutes, regulations, professional requirements, court rules, and retention obligations;
resolve disputes; and
establish or defend legal claims.

Reporter notes, transcripts, exhibits, recordings, and other proceeding materials may be subject to specialized retention requirements under applicable law.

Hines maintains reasonable administrative, physical, and technical safeguards designed to protect personal information against unauthorized access, acquisition, loss, alteration, disclosure, or destruction.

No system or method of electronic transmission or storage can be guaranteed to be completely secure.

11. Your Privacy Rights

Depending on where you reside and subject to applicable exemptions, you may have rights to:

know whether Hines processes your personal information;
request access to personal information;
obtain information regarding categories of personal information collected;
correct inaccurate personal information;
request deletion of personal information;
obtain a portable copy of certain information;
opt out of certain sales, sharing, targeted advertising, or profiling where applicable; and
appeal certain privacy decisions where required by law.

Hines will not unlawfully discriminate against an individual for exercising applicable privacy rights.

Hines may verify your identity before fulfilling a request.

An authorized agent may submit a request where permitted by applicable law, subject to appropriate verification.

Certain information may be exempt from privacy requests because of legal obligations, litigation, evidentiary requirements, professional obligations, attorney-client relationships, court rules, or other statutory exceptions.

12. California Privacy Rights

California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”).

During the preceding twelve months, depending upon the individual’s interaction with Hines, Hines may have collected the following CCPA categories:

identifiers;
personal information described in California Civil Code § 1798.80;
characteristics of protected classifications where provided in connection with Services;
commercial information;
internet or electronic network activity;
approximate geolocation information;
audio, electronic, visual, or similar information;
professional or employment-related information;
sensitive personal information where necessary to provide Services; and
inferences where applicable.

Hines collects these categories from the sources and for the purposes described elsewhere in this Privacy Policy.

California residents may request information regarding Hines’ collection, use, and disclosure of personal information, request correction or deletion, and exercise other rights provided by the CCPA, subject to statutory exceptions.

Where Hines processes sensitive personal information, Hines does not use or disclose such information for purposes that trigger a right to limit under the CCPA unless otherwise disclosed.

Hines does not knowingly sell or share personal information belonging to persons under sixteen (16).

Shine the Light

California residents may also have rights under California’s “Shine the Light” law concerning disclosure of certain personal information for third parties’ direct-marketing purposes.

Hines does not currently disclose personal information to third parties for their own direct-marketing purposes in a manner requiring such disclosure.

13. Global Privacy Control and Do Not Track

Where required by applicable law, Hines will recognize legally valid browser-based opt-out preference signals, including Global Privacy Control, for processing to which such signals legally apply.

Because “Do Not Track” is distinct from legally recognized opt-out preference signals and lacks a uniform industry standard, the Site may not respond to traditional Do Not Track signals.

14. Marketing Communications

You may unsubscribe from marketing emails using the unsubscribe mechanism provided in those messages or by contacting Hines.

Even if you opt out of marketing, Hines may continue sending transactional, scheduling, service, billing, security, or legally required communications.

15. Other Websites and Services

Our Site may link to third-party websites or platforms. Their privacy practices are governed by their own policies, not this Privacy Policy.

16. International Processing

Hines is headquartered in California and primarily operates from the United States. Information may be processed in other jurisdictions when Hines uses service providers or professionals located elsewhere.

Where applicable law requires safeguards for international transfers, Hines will implement appropriate transfer mechanisms.

17. Children’s Privacy

The Site and Services are directed toward legal professionals, businesses, and adults and are not intended for children under thirteen (13).

Hines does not knowingly collect personal information directly from children through the Site without appropriate authorization.

Information about minors may nevertheless appear in litigation materials provided to Hines in connection with legal proceedings. Such information is handled as part of the applicable professional service rather than collected from a child as a website user.

18. Changes to This Privacy Policy

Hines may update this Privacy Policy periodically.

When changes are made, the “Last Updated” date will be revised. Material changes may be communicated through additional reasonable notice where appropriate or legally required.
